USAGE POLICY, PRIVACY NOTICE AND DATA SECURITY POLICY

INTRODUCTION

Mr Mowll Learning t/a Maths Generator (hereafter also referred to as 'Maths Generator' and / or 'we', 'us', 'our') provides the content and features of www.mathsgenerator.com (hereafter also referred to as 'the Site') for the purpose of enhancing teaching and learning both outside and inside a classroom setting.

For the purposes of this document the terms 'School', 'School Account', 'Teacher' and 'Student' are as defined in a Subscription Agreement. Subscriptions are not available to individuals.

The site is available to users (hereafter referred to as 'User(s)', 'you' and / or 'your') who are either members of a School Account or individuals who register on the Site (on the terms set out below).

This document includes the following:

  • Usage Policy which sets out the basis on which Users must use the Site.
  • Privacy Notice which is intended to help you understand what information, including personal information, we collect, how it is processed when you use the Site and how it will be processed by Maths Generator to meet our objectives of delivering a beneficial experience. Maths Generator reserves the right to modify the Privacy Notice at any time without giving you prior notice.
  • Data Privacy Policy which sets out the practical, organisational and technical measures Maths Generator takes to protect personal data.

USAGE POLICY

Once a User has created an account and signs in with Maths Generator, they are responsible for maintaining the confidentiality of their online account and password and preventing unauthorized access to their Maths Generator account or to the Site in general. Users are responsible for all their actions conducted on the Site under their account credentials when they are logged in.

Users may not download or reproduce questions, answers or any other part of the Site for any usage other than personal usage.

The Site may contain links including hyperlinks which may take you to other websites. Links are provided for your convenience and an inclusion of any link does not imply endorsement or approval by us of the linked website, its operator or content. We have no control over the contents or functionality of those sites and accept no responsibility for any loss or damages that may arise from your use of them. In particular, Maths Generator is not responsible for the content within the YouTube help videos embedded in the Site but will respond to any notifications that such embedded content has become unavailable or is inappropriate.

Maths Generator reserves the right to make any changes to the Site and all resources (including, without generality to the foregoing, changes to the content, method of display and delivery, and the right to remove, temporarily or permanently, certain resources at our sole discretion and without prior notice).

To the fullest extent permitted by law, Maths Generator will not be liable for damages should the Site become unavailable or should access to the Site become slow or incomplete for any reason. Maths Generator’s total cumulative liability to a claimant, whether in contract, tort (including negligence), for breach of statutory duty or otherwise, in connection with providing the Site or in connection with these terms and conditions or otherwise, shall be limited to an amount equivalent to 100% of any fees paid or payable by the claimant in the preceding twelve months from the date the claim first arose.

Maths Generator is committed to providing the Site for educational and gamification purposes but access to the Site is at sole discretion of Maths Generator; any User’s right to use the Site may be suspended if they misuse the Site, which activity may include but is not limited to:

  • Any unlawful activity, or any activity which is likely to cause the Site or access to it to be interrupted, damaged or impaired in any way.
  • Using any form of software to repetitively click or perform excessive automated actions on behalf of a User.
  • Excessive use of the Game.
  • Unnatural patterns of answering excessive numbers of questions on the Site.
  • Attempting to duplicate or ‘hack’ any part of the Site.
  • Causing or enabling any form of cyber-attack, including any form of Denial-of-Service or scripting attack.

It is at Maths Generator’s sole discretion whether the suspension of a User is temporary or permanent.

PRIVACY NOTICE

Data Collection and Processing

  • When you visit the Site, and you are not logged in then we will not collect any personal data about you. We may however collect anonymous data such as what pages are visited, in what order and how long for.
  • We collect personal data once you register. Personal information that is collected varies according to how the individual uses the Site and whether directly with the Site or through a School Account.
  • For Students (and individuals accessing the Site via the website and not through a School Account), the primary elements of personal data that is collected on the Site are full name, email address and (if chosen to disclose this when registering individually or as part of a School upload of data) the name of the Student’s School. We will also collect the data and time of your registration. We use email addresses for identifying Users and the automated resetting password functionality.
  • For Teachers, the primary elements of personal information that is collected on the Site are full name, School email address and the name of the School. We use Teacher email addresses for the resetting password functionality, contacting Teachers if there are any issues or misuse of Site accounts from their School, and verifying the identity of a Teacher. We use the name of the School to ensure that Teachers can only view information relating to Students who are part of their School.
  • The Site stores other data relating to interactions with the Site, for example: information on progress with the game, tasks set, questions attempted, answers provided, and videos watched.
  • Maths Generator processes personal data on the basis of legitimate interests in order to provide the features of the Site (and in some cases to fulfil the terms of a subscription contract between Maths Generator and a School).
  • We use necessary cookies to ensure proper functionality of the Site, such as enabling login sessions. These cookies are essential for the operation of the Site.

Data Sharing

  • Users data is only used for the purposes of providing the functionality of the Site and is not shared with any third party besides Google Cloud and Amazon Web Services whose services help run the Site.
  • Users cannot see other User’s personal data (provided that Teachers can view the personal data of Users within their School).
  • Teachers cannot view the personal email addresses of any Student (at their School) who has created an account outside a School Account.

Data Retention

  • Schools and individual Users (not associated with a School Account) can request to have their account and data permanently deleted at any time via email to MrMowll@MathsGeneratorSupport.com. Note that in the case of a Student account, any such request may also require the consent of a Teacher of the Student’s School.
  • Teachers can delete Student accounts from within their School. Such deletions are reversible for up to 18 months from the initial deletion. Schools are responsible for deleting or requesting the deletion of Users that have left their educational establishment or who no longer have legitimate access to data within their educational establishment.
  • Personal data relating to User accounts that have not been logged in for over 18 months are automatically deleted.

Data Rights and Complaints

  • If after contacting Maths Generator regarding your personal data, you are not satisfied with the response, you have the right to lodge a complaint with the ICO (https://ico.org.uk/).

DATA SECURITY POLICY

Maths Generator takes the following practical, organisational and technical measures to protect personal data submitted to the Site:

  • The Site runs on HTTPS which means communications between Users and the Site are encrypted.
  • The Site’s database can only be accessed from within an Amazon Web Services (AWS) private network or secured SSH tunnels available to Site administrators and is not publicly accessible due to an AWS firewall.
  • User data is only stored on an AWS server or in the Google Cloud. Both Amazon and Google provide sophisticated defences to secure data they store.
  • The Site’s database supports Data-At-Rest encryption.
  • The Site’s database records an auditing log, so that all updates to it are recorded and stored outside of the Site’s database.
  • Automatic backups of the Site’s server and database are automatically taken daily and can be restored when required.
  • The Site’s server and database are automatically updated regularly.
  • All Site administrators have console access to the Site’s server and database and have Multi-Factor Authentication enabled for their console logins.
  • The Site allows Users to authenticate via Microsoft or Google via the OAuth2 protocol.
  • Users cannot see other User’s personal data (provided that Teachers can only view the personal data of Users within their School).
  • The Site’s security has been subjected to penetration testing by Syscomm Limited.
  • Mr Mowll Learning is registered with the Information Commission Office (ICO); ICO number: ZB839178.
  • Maths Generator does not store and cannot access User passwords – these are stored by Google Cloud.
  • The Site’s database permissions are configured so that only the minimal necessary permissions are granted to any Users of the Site’s database.

Despite the measures above, no method of security should be regarded as 100% secure. We endeavour to protect Personal Identifiable Information but cannot guarantee its absolute security and data transmissions through the Site are made at User’s own risk.

Virus Notice

Other than usages mentioned above, Maths Generator only sends emails to Users to help them register or reset their password. We take appropriate measures to ensure the security of the Site and its communications as detailed above, however Users are responsible for taking appropriate precautions to ensure that any email or attachment they open is virus free, and Maths Generator does accept responsibility for any loss or damages sustained as a result of a computer virus.
